Please read these Terms of Service ("Terms") carefully before placing an order with Emily's Property Reports ("we," "us," or "our"). By placing an order you agree to be bound by these Terms.
1. Description of Service
Emily's Property Reports provides comparable sales data analysis, property characteristic research, and sample appeal argument templates to help Boulder County homeowners understand their property tax assessments and prepare their own appeals. Our reports are informational tools — not legal advice, not licensed real estate appraisals, and not a guarantee of any outcome.
2. Not Legal Advice; Not a Licensed Appraisal
Our reports do not constitute legal advice and do not create an attorney-client relationship. We are not attorneys. Nothing in our reports should be construed as legal counsel.
Our reports are not licensed real estate appraisals under Colorado law (C.R.S. § 12-10-601 et seq.) and are not intended to be used as such. They are data analysis products for the personal use of the property owner in preparing a self-filed appeal.
3. You File Your Own Appeal
Our service delivers a report and a sample appeal argument template. You are responsible for reviewing, adapting, and submitting your own appeal to Boulder County. We do not file appeals on your behalf.
4. No Outcome Guarantee
We do not guarantee that your appeal will result in a reduction of your assessed value. The county's Board of Equalization makes all decisions independently. What we guarantee is a thorough analysis using the county's own comparable sales data.
5. Refund Policy
If we cannot identify a justification for a reduction in your assessed value of more than 10%, we will issue a full refund before delivering your report. Once your report is delivered, all sales are final — your report is a custom digital deliverable prepared specifically for your property. See our full Refund Policy.
6. Service Area
We currently serve Boulder County, Colorado only. Orders for properties in other counties will be refunded in full.
7. Accuracy of Information
Our analysis is based on Boulder County's publicly available comparable sales data and county records. While we strive for accuracy, we make no warranty that county records are free from error.
8. Limitation of Liability
To the fullest extent permitted by law, Emily's Property Reports is not liable for any indirect, incidental, or consequential damages arising from your use of our reports or the outcome of your appeal. Our total liability is limited to the amount you paid for your report.
9. Intellectual Property
Our reports are licensed for your personal use only. You may not resell, redistribute, or use our reports for commercial purposes without our written consent.
10. Governing Law
These Terms are governed by the laws of the State of Colorado. Any disputes shall be resolved in the state or federal courts located in Boulder County, Colorado.
11. Changes to Terms
We may update these Terms from time to time. Continued use of our service after changes constitutes acceptance of the new Terms.
